Terms of Service

These Terms of Service ("Terms") govern your use of Socialfy, the social media management platform operated by Hostify (Pty) Ltd ("Hostify", "we", "our" or "us"), available at socialfy.co.za.

By registering for, accessing or using Socialfy, you accept and agree to be bound by these Terms. If you do not agree to these Terms, do not use the service.

We may revise these Terms from time to time. The latest version will always be available at this page. By continuing to use Socialfy after changes take effect, you accept the updated Terms.

1. The service

Socialfy is a social media management platform. It lets you connect your own social media accounts (such as TikTok, Facebook, Instagram, LinkedIn, X or YouTube) and draft, schedule and publish content to those accounts with your explicit approval. Nothing is published without your approval. Connecting an account does not give us control of that account beyond the permissions you grant, and you may disconnect any account at any time.

2. Registration and account security

To use Socialfy you must be at least 18 years old. You must provide accurate and complete details when you register. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must inform us without delay of any actual or suspected unauthorised use of your account.

You are not permitted to use any account registered to another person without their explicit authorisation. We may require you to change your credentials, or suspend or terminate your account, if we reasonably believe there is a breach of security or misuse.

3. Your content and your responsibility

Content you publish through Socialfy remains your responsibility. You warrant that you have the rights to any content you create, schedule or publish, and that it does not infringe the rights of any third party.

You are responsible for ensuring your content complies with the terms and policies of the social media platforms you connect, and with all applicable laws, including in respect of advertising, sponsored content and consumer protection. You agree not to use Socialfy to publish spam, misleading, deceptive, infringing or unlawful content.

4. Platform terms

Socialfy connects to third-party platforms through their official APIs. Your use of those platforms remains subject to their own terms and policies, which may change or may be revoked by the platform at any time. We are not responsible for the actions, availability or policies of the platforms you connect, and you agree to comply with their terms when using Socialfy to interact with them.

5. Acceptable use

You agree that you will not:

• use Socialfy for any unlawful purpose or in a way that violates any platform's terms or policies;
• attempt to gain unauthorised access to Socialfy, other users' accounts, or connected platform accounts;
• use Socialfy to send spam, inauthentic engagement, or content that harasses, defames or harms others;
• use Socialfy to operate accounts you do not own or are not authorised to manage;
• interfere with or disrupt the service, its infrastructure or other users' use of it.

6. Service availability

We endeavour to keep Socialfy available, but we do not guarantee uninterrupted availability. We may change, suspend or discontinue any part of the service at any time, with or without notice. To the extent permitted by law, we are not liable for any disruption, non-availability, delay, error or technical fault in the service.

7. Intellectual property

The Socialfy software, design, brand and related materials are owned by or licensed to Hostify and are protected by intellectual property laws. Nothing in these Terms grants you any rights in the service other than the right to use it in accordance with these Terms.

8. Limitation of liability

To the maximum extent permitted by law, Hostify will not be liable for any indirect, incidental, special or consequential loss or damage, or for any loss of profits, data or goodwill, arising out of or in connection with your use of Socialfy, including any actions taken by third-party platforms in respect of your connected accounts. Nothing in these Terms limits liability that cannot be limited under applicable law.

9. Termination

You may stop using Socialfy and delete your account at any time. We may suspend or terminate your access if we reasonably believe you have breached these Terms, without prejudice to any other rights we may have.

10. Governing law

These Terms are governed by and construed in accordance with the laws of South Africa, and you submit to the jurisdiction of the South African courts for the resolution of any disputes.
